1. Introduction

Welcome to The Taste Machine ("we," "our," or "us"). By accessing or using our AI-powered image generation platform at thetastemachine.com, including its web workspace and API (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Service Description

The Taste Machine provides taste-aware AI image generation through:

• A web workspace for generating images guided by a chosen taste profile
• A public HTTP API authenticated with API keys for programmatic access
• Optional reference image inputs that the taste engine analyses alongside your brief
• Cloud storage for generated outputs

The taste engine constructs prompts that are passed to an underlying foundational image-generation model (such as Nano Banana Pro). All features require credits to use.

3. Account Registration

To use our Service, you must:

• Create an account with accurate and complete information
• Be at least 18 years of age or have parental consent
• Maintain the security of your account credentials and any API keys you generate
• Notify us immediately of any unauthorised access or suspected key compromise

You are responsible for all activities that occur under your account or via your API keys.

4. Credits System

4.1 How Credits Work

Our Service operates on a credit-based system. Each generation request consumes credits from your account balance. The exact credit cost varies by model, output configuration, and other parameters.

4.2 Free Credits

New users receive complimentary credits upon registration to try the Service. Free credits are subject to change without notice and cannot be transferred or redeemed for cash.

4.3 Credit Expiration

• Subscription Credits: Credits from monthly subscriptions expire at the end of each billing cycle. Credits from annual subscriptions expire one year from the subscription start date.
• Purchased Credits: Credits purchased through one-time credit packs do not expire and remain available until used.

5. Subscription Plans

5.1 Plan Types

We offer subscription plans (Basic, Pro, and Business) with both monthly and annual billing options. Each plan includes a specific number of credits per billing period.

5.2 Billing and Renewal

• Monthly subscriptions renew automatically on the same day each month
• Annual subscriptions renew automatically after one year
• You will be charged the then-current rate upon renewal
• We will notify you of any price changes before they take effect

5.3 Cancellation

You may cancel your subscription at any time by contacting customer support. Cancellation will take effect at the end of your current billing period. You will retain access to subscription credits until expiration. We do not provide refunds for partial billing periods.

6. Credit Packs

In addition to subscriptions, we offer one-time credit packs (Mini, Medium, and Max) that can be purchased at any time. Credit pack purchases are:

• One-time, non-recurring charges
• Non-refundable after purchase
• Credits that never expire
• Used after subscription credits are depleted

7. Payment Terms

All payments are processed securely through Stripe. By providing payment information, you:

• Authorise us to charge your payment method for all fees
• Confirm that you are authorised to use the payment method
• Agree to pay all applicable taxes
• Understand that all sales are final unless otherwise stated

8. Content and Usage Rights

8.1 Your Content

You retain all ownership rights to briefs and reference images you submit to our Service. By submitting content, you grant us a limited licence to process, store, and display your content solely to provide the Service.

8.2 Generated Images

Images generated through our Service belong to you, subject to these terms and to the terms of the underlying foundational model. You may use generated images for commercial or personal purposes. However, you are responsible for ensuring that:

• Your use complies with all applicable laws
• You do not infringe on third-party rights
• You do not use images for illegal, harmful, or deceptive purposes

8.3 Prohibited Uses

You may not use our Service to create, upload, or generate content that:

• Is illegal, harmful, threatening, abusive, or discriminatory
• Violates intellectual property rights
• Contains malware or malicious code
• Impersonates others or misrepresents your affiliation
• Depicts explicit, violent, or age-restricted content without proper safeguards

9. Intellectual Property

The Service, including its software, taste engine, taste profiles, design, text, graphics, and trademarks, is owned by The Taste Machine and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

10. Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. Outages may also result from issues with upstream foundational model providers. We are not liable for any service interruptions or changes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TASTE MACHINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM:

• Your use or inability to use the Service
• Unauthorised access to your account, data, or API keys
• Errors, bugs, or security vulnerabilities
• Third-party content, foundational models, or services

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free, secure, or meet your requirements, nor that any specific generation will match your expectations.

13. Indemnification

You agree to indemnify and hold harmless The Taste Machine and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of third-party rights.

14. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

15. Termination

We may suspend or terminate your account or revoke API keys at any time if you violate these terms or engage in fraudulent or harmful activities. Upon termination, your right to use the Service ceases immediately, and we may delete your data. Provisions regarding payment obligations, intellectual property, and limitations of liability survive termination.

16. Governing Law

These Terms and Conditions are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
